for performances by Nyna Dubois (Nyna Voice) as a wedding singer, event singer, and DJ

1. Scope of Application

These General Terms and Conditions (GTC) apply to all engagements, contracts, and services provided by Nyna Voice as a singer, pianist, and DJ for weddings, wedding ceremonies, apéritifs, evening events, memorial services (funeral ceremonies), and similar events.
By booking a service, the client agrees to these GTC.

2. Offer and Conclusion of Contract

A contract is concluded upon confirmation by the client—regardless of whether this confirmation is made in writing, by email, via WhatsApp, or through any other means of communication.
Upon confirmation, the booking becomes binding.

In addition, a separate written contract will be prepared by Nyna Voice and sent to the client for signature.

Offers are non-binding. Changes are reserved.
Individual agreements deviating from these GTC must be made in writing.

3. Services

The services are based on the agreement specified in the contract or offer. These include in particular:

• Singing at wedding ceremonies (solo or duo)

• Singing for apéritifs, dinners, corporate events, memorial services (funeral ceremonies)

• DJ sets with or without live vocals

• Rehearsal of individual requested songs

• Provision and use of technical equipment (as agreed)

Additional requests (e.g., spontaneous extension of performance time, additional equipment, special song requests) will be charged separately.

Appearances are generally conducted in an elegant style appropriate to the event (“casual elegant”).
Special clothing requests by the client are only valid if agreed upon in writing at least 14 days before the event and may incur additional costs.

4. Prices and Payment

All prices are stated in Swiss Francs (CHF).
Expenses such as accommodation (if required), additional equipment, SUISA fees, parking fees, and catering on the event day are not included in the base price and will be charged separately.

Payment is generally due after the event and payable within 10 days of invoicing.
(Optional: A deposit may be agreed upon and is payable in advance.)

5. Cancellation by the Client

In the event of cancellation by the client, the following conditions apply:

• From definitive booking: 80% of the agreed fee

• From 14 days before the event: 100% of the agreed fee

Any costs already incurred (e.g., equipment rental, accommodation, SUISA fees, parking fees) must be reimbursed in all cases.

6. Cancellation by the Artist

If Nyna Voice is unable to perform due to serious reasons (e.g., illness, force majeure), a comparable replacement will be arranged to the best of her knowledge and belief under the same conditions. Payment will be processed as specified in the contract via Nyna Voice.

If no replacement can be found:
In this case, the client will incur no costs, and any payments already made will be refunded.
Further claims for damages are excluded.

7. Obligations of the Client

The client ensures that a suitable performance location, power supply, and the agreed space for equipment and instruments are available.
For outdoor events, weather protection for the artist and equipment must be provided. Any resulting damage will be borne by the client.

The client is liable for damage to provided or brought-in equipment if caused by guests or third parties.

Delays caused by the organizer or the event schedule that result in exceeding the contractually agreed time will be charged additionally: CHF 200 per commenced 15 minutes.

8. Liability

Nyna Voice is liable for her own equipment within the scope of due care.
Liability exists only in cases of intent or gross negligence. Any further liability, in particular for consequential damages, is excluded.

The client is liable for damage to equipment brought by Nyna Voice if caused by guests, the client, or third parties.

No responsibility is assumed for failures or damage outside the control of Nyna Voice (e.g., power outages, weather conditions, guest behavior).

9. Usage Rights (Photos / Video)

Photos or videos created during the performance by Nyna Voice herself or provided by guests may be used for promotional purposes (website, social media) unless otherwise agreed in writing.
The client has the right to prohibit such use in writing.

10. Final Provisions

Amendments and additions to these GTC must be made in writing.
If individual provisions are invalid, the validity of the remaining provisions remains unaffected.

Swiss law applies exclusively. Place of jurisdiction is Bern.

By booking a service, the client confirms that they have read and accepted these General Terms and Conditions.
